Default Form to have SC DOT pay for vehicle damage due road debris.

we talked about this in another thread, but i had to dig it all up, buddy lost a windshield.



How do I file a claim against SCDOT?

The South Carolina Tort Claims Act (Section 15-78-10) allows an individual
to file a claim against the Agency. To file a claim against SCDOT, a Damage Claim Form (Form 2062) can be filled out. An individual has one year from the date of occurrence to file a damage claim. Under the South Carolina Tort Claims Act, the Agency or its insurance carrier has 180 days after a claim is received to make a decision whether the claim is paid or denied.

To file a claim for damage resulting from a roadway condition, fill out a Damage Claim Form and submit this form along with two repair estimates or a paid invoice to the SCDOT Maintenance Office in the county where the incident occurred. If the claim is being submitted for damage to a registered vehicle, the registered owner(s) must be the claimant(s) and a copy of the vehicle registration must be included.

you have to take the form and 3 estimates to the DOT office on the frontage road that connects to Aviation Avenue. Its down on the left.

i mailed mine in today, was for 2 fog lites

some body posted this on another forum (maybe this one) and it had hand written instructions, with the below address. it was the post about the roads being so bad, and hoods being scratched.

We picked up 2 of those forms for the Integra's windshield and the Monster's windshield. Never filled them out though or sent them in - didnt really have time to get three written estimates from different glass shops.

i just took a month to do the form: filled it out, laid on desk a week, put it in truck, laid there week, went to bank, again, to bank third time: finally remembered to get it notarized.

bought fog lights off ebay,
took pics with digi-cam

sent in receipt (printed out the page from Ebay/paypal)
pics,
notarized form.

waited few more months.

woo hoo!

i would think if you just had the windshield done, and sent in the form, they might do it.

figured it was worth the chance for me, it had been so long, i thought they denied it

I'm about to make a claim against them for a cracked Motorsport Rim on my M3. The rim has been leaking about 10 psi a day so I pulled it off to discover a hairline crack on the inner lip. I know I hit a pot hole/manhole a couple days before I noticed the tire was slack on air. The rim retails for around $550 new from BMW. It's hard to find the rims used because they're pretty rare. I don't have a spare so I'm left to borrow my parents car while I see if they accept the claim. Does anyone know how long it takes to get a check from them? I do not want to have it welded because I heard the wheel can never be balanced right.

Good luck for getting them to replace a wheel. I know usually they will do the windshield and paint job (on front) due to rocks on the road. As far as manhole cover/pothole. I would get a picture of where it happened and go from there. Most likely the state will say "you should have watched where you were going" if you have no evidence.

i heard they stopped paying when a Mercedes owner tried to get his 90k car repainted.
